1. 목적
본 약관은 Overwater(이하 "앱")의 이용 조건과 절차, 운영자와 사용자의 권리·의무 및 책임을 정함을 목적으로 합니다.
2. 정의
- 앱: Overwater 모바일 애플리케이션 및 onsoonlabs.com/overwater 웹페이지를 통칭합니다.
- 사용자: 본 약관에 동의하고 앱을 이용하는 모든 개인을 말합니다.
3. 약관의 효력 및 변경
- 본 약관은 앱 내 메뉴 및 onsoonlabs.com/overwater 에 게시하고, 문서 상단에 표시된 시행일이 도래한 때부터 효력이 발생합니다. 시행일 전에 게시된 판은 사전 안내이며 그 자체로 효력이 발생하지 않습니다.
- 운영자는 관련 법령 및 서비스 운영상 필요한 경우 약관을 변경할 수 있으며, 변경 시 시행 7일 전(수집 항목 추가·이용 목적 변경 등 중대한 변경은 30일 전)에 앱 내 공지 또는 업데이트를 통해 안내합니다.
- 변경된 약관 시행 이후에도 사용자가 앱을 계속 이용하는 경우 변경된 약관에 동의한 것으로 봅니다.
4. 서비스 이용
- Overwater는 동네 날씨를 근거로 오늘 할 일을 정리해주는 개인용 데일리 앱입니다.
- 앱은 회원가입 절차 없이 익명으로 사용할 수 있습니다. 날씨 확인, 생활 조언, 빠른 할 일, 조도계, Wiki 등 핵심 기능은 로그인 없이 이용 가능합니다.
- 만 14세 미만 아동도 익명으로 앱을 사용할 수 있습니다. 앱에는 인앱 결제나 구독 구매 기능이 없습니다.
5. 사용자의 책임
- 앱이 안내하는 날씨 기반 생활 조언과 AI 생성 텍스트는 일반적인 참고용이며, 실제 환경에 따라 결과가 달라질 수 있습니다.
- 식물의 안전, 보호자(반려동물·어린이)의 안전, 사용자 본인의 건강에 관한 최종 판단은 사용자에게 있습니다.
- 산림청·농업기술원 등 공인 출처의 안내가 있을 경우 해당 안내를 우선해 주십시오.
- 사용자는 앱을 본 약관 및 관련 법령을 위반하는 용도로 사용해서는 안 됩니다.
AI 음성·생성 기능 사용 제한
Overwater의 읽어주기 음성은 사람이 직접 녹음한 것이 아니라 기기에서 AI로 생성되는 합성 음성이며, 식물 Wiki 항목의 일부 안내 문구도 AI가 생성합니다. 사용자는 이 음성·생성 기능과 그 결과물(생성된 음성·텍스트)을 다음 목적으로 사용해서는 안 됩니다.
- 관련 법령을 위반하는 행위
- 미성년자를 착취하거나 해치는 행위
- 타인에게 해를 끼칠 목적의 허위 정보 생성·유포
- 타인에게 해가 될 수 있는 개인정보 생성·유포
- 명예훼손, 비방, 괴롭힘
- 동의 없는 타인 음성·인격 사칭 또는 딥페이크
- AI가 생성한 음성·콘텐츠임을 명확히 밝히지 않은 채 배포하는 행위
- 개인의 법적 권리·의무에 영향을 주는 완전 자동화된 의사결정
- 사회적 행동이나 개인적 특성, 법적으로 보호되는 특성을 근거로 한 차별·가해
- 특정 집단의 취약성을 악용해 사람에게 해를 끼치는 행위
- 의료 조언 또는 의료 결과 해석
- 사법·수사·이민·망명 절차에서 개인을 평가·예측하는 용도
이 제한은 읽어주기 음성에 사용된 온디바이스 모델(Supertonic-3, Supertone, Inc., BigScience Open RAIL-M 라이선스)의 사용 조건에 따른 것입니다. 앱에 내장된 모델 자체나 이를 추출한 사본을 별도로 사용·배포하는 경우에도 위 제한과 BigScience Open RAIL-M 라이선스 조건이 동일하게 적용됩니다. 자세한 라이선스 전문은 앱의 "오픈소스 및 데이터 출처" 화면에서 확인할 수 있습니다.
6. 서비스 제공의 한계
- Overwater는 1인 운영 앱으로, 서버 점검·외부 API 변동·기기 환경에 따라 일부 기능이 일시적으로 중단될 수 있습니다.
- 데이터 손실 가능성을 줄이기 위해 핵심 정보는 기기 로컬에 우선 저장되지만, 영구 보존을 보장하지 않습니다. 사용자는 중요한 정보를 별도로 백업할 책임이 있습니다.
- 운영자는 무료 서비스의 일시 중단·변경·종료에 대해 사용자에게 손해배상 책임을 지지 않습니다.
7. 이용 요금
- Overwater의 모든 기능은 무료로 제공됩니다. 식물 Wiki 항목의 AI 생성 기능을 포함해 요금을 받는 기능이 없습니다.
- 앱에는 유료 상품·구독 판매, 결제, 구매 복원 화면이 없으며, 그에 따르는 갱신·해지·환불 절차도 존재하지 않습니다.
- 앱 이용에 필요한 데이터 통신 요금은 사용자가 가입한 통신사의 요금제에 따릅니다.
8. 개인정보 보호
개인정보의 수집·이용·제공·파기 등에 관한 사항은 별도의 개인정보 처리방침에 따릅니다.
9. 권리 침해 신고 및 분쟁 해결
- 앱 이용 중 권리 침해, 부적절한 콘텐츠, 기술적 문제 등이 있는 경우 support@onsoonlabs.com 로 문의해 주십시오.
- 본 약관과 관련하여 분쟁이 발생한 경우, 대한민국 법령에 따라 해결합니다.
- 소송이 필요한 경우 운영자 주소지를 관할하는 법원을 제1심 관할 법원으로 합니다.
10. 면책
- 앱은 외부 데이터(날씨, 식물 정보, AI 생성 텍스트 등)의 정확성을 보장하지 않습니다.
- 사용자가 앱의 안내에 따라 행한 결정으로 발생한 결과에 대해, 운영자는 관련 법령상 허용되는 범위 내에서 책임을 지지 않습니다.

아래는 시행 전 문서의 개정 기록입니다. 과거 행에 나오는 Plus 유료 구독은 실제로 판매된 적이 없고(스토어에 상품을 등록한 적이 없습니다), v1.5 부터 앱은 전면 무료입니다.

Version: 1.8 | Effective: on the app's initial release date
1. Purpose
These Terms govern the conditions for using Overwater (the "App"), and define the rights, obligations, and responsibilities of the operator and users.
2. Definitions
- App: refers collectively to the Overwater mobile application and the onsoonlabs.com/overwater web pages.
- User: an individual who agrees to these Terms and uses the App.
3. Effect and changes
- These Terms are posted in the in-app menu and on onsoonlabs.com/overwater, and take effect on the effective date shown at the top of this document. A version posted before that date is advance notice and does not take effect on its own.
- The operator may revise these Terms when required by applicable law or service operations. Changes are announced at least 7 days before the effective date (30 days for material changes such as added collection items or changes in purpose of use).
- Continued use of the App after a change takes effect is treated as acceptance of the revised Terms.
4. Service use
- Overwater is a personal daily app that turns local weather into a single suggestion for what to do today.
- The App can be used anonymously without sign-up. Core features such as weather, lifestyle advice, quick tasks, the light meter, and Wiki work without an account.
- Children under 14 may use the App anonymously. The App has no in-app purchases and no subscription purchase flow.
5. User responsibilities
- Weather-based lifestyle advice and AI-generated text shown in the App are general reference. Actual outcomes depend on each environment.
- Final safety decisions for plants, household members (pets, children), and the user's own health rest with the user.
- When official sources (forestry service, agricultural extension) provide guidance, please defer to them.
- Users must not use the App in violation of these Terms or applicable law.
Restrictions on AI voice and generation features
Overwater's read-aloud voice is not recorded by a person; it is a synthetic voice generated on your device by AI, and some guidance text in plant Wiki entries is also AI-generated. Users may not use these voice or generation features, or their output (the generated voice or text), to:
- violate any applicable law or regulation;
- exploit or harm minors in any way;
- generate or disseminate verifiably false information intended to harm others;
- generate or disseminate personal information that could be used to harm an individual;
- defame, disparage, or harass others;
- impersonate others or create deepfakes without their consent;
- distribute AI-generated voice or content without clearly disclosing that it is machine-generated;
- make fully automated decisions that affect an individual's legal rights or obligations;
- discriminate against or harm individuals or groups based on social behavior, personal characteristics, or legally protected characteristics;
- exploit the vulnerabilities of a specific group to cause harm;
- provide medical advice or interpret medical results;
- assess or predict individuals in the administration of justice, law enforcement, immigration, or asylum processes.
These restrictions follow the usage terms of the on-device model used for the read-aloud voice (Supertonic-3 by Supertone, Inc., under the BigScience Open RAIL-M License). The same restrictions and the BigScience Open RAIL-M License terms also apply if the bundled model itself, or any copy extracted from the app, is used or redistributed separately. The full license text is available in the app's "Open Source & Data Sources" screen.
6. Limits of service
- Overwater is solo-operated. Server maintenance, third-party API changes, and device conditions may cause temporary feature outages.
- Core data is stored locally on the device first to minimize loss, but permanent retention is not guaranteed. Users are responsible for backing up important information.
- The operator is not liable for damages arising from temporary interruption, change, or termination of free services.
7. Fees
- Every feature of Overwater is provided free of charge. No feature, including AI-generated plant Wiki entries, carries a fee.
- The App has no paid products or subscriptions for sale and no payment or purchase-restoration screens, so there are no renewal, cancellation, or refund procedures.
- Any mobile data charges incurred while using the App follow the plan of the user's own carrier.
8. Privacy
The collection, use, sharing, and deletion of personal information are governed by the separate Privacy Policy.
9. Complaints and dispute resolution
- For rights infringement, inappropriate content, or technical issues, please contact support@onsoonlabs.com.
- Disputes related to these Terms are resolved under Korean law.
- The court of competent jurisdiction for the operator's domicile shall be the court of first instance.
10. Disclaimer
- The App does not guarantee the accuracy of external data (weather, plant information, AI-generated text, etc.).
- Within the scope permitted by applicable law, the operator is not liable for outcomes resulting from decisions a user makes based on App guidance.
